Nagpur High Court Rejects Sandeep Developers Plea Against NMRDA Infrastructure Charges Good Morning Nagpur
Nagpur: The Nagpur Bench of the Bombay High Court has delivered a major setback to Sandeep Developers Pvt. Ltd. and the Agrawal family by dismissing their petition challenging the infrastructure charges imposed by the Nagpur Metropolitan Region Development Authority (NMRDA). In its decision, the court clarified that developers who accept the prescribed conditions while obtaining layout approval cannot later challenge the charges imposed under those same conditions. The case was related to infrastructure charges levied by NMRDA for layout development and the provision of essential infrastructure facilities. Sandeep Developers Pvt. Ltd. and the Agrawal family had approached the court challenging these charges. However, the court rejected their arguments and dismissed the petition. The High Court held that the infrastructure charges imposed by NMRDA were justified under the Maharashtra Regional and Town Planning (MRTP) Act and the relevant development regulations. The ruling sends an important legal message regarding the conditions and charges imposed by development authorities during layout approvals. It also highlights that developers must carefully understand and accept the applicable rules and conditions while obtaining project approvals, as challenging those same conditions at a later stage may not be permissible.
